Welcome to Trisakay — a digital tricycle-hailing and transport facilitation platform that connects commuters, drivers, and operators in Ormoc City. By using our services, you acknowledge and agree to these Terms, which establish a binding legal agreement between you and Trisakay.
If you do not agree with any part of these Terms, please refrain from accessing or using the platform.
2. Platform Overview
Trisakay serves as a technology intermediary that facilitates bookings, communication, and fare transactions between passengers and accredited tricycle drivers.
The platform itself does not own, manage, or operate tricycles. All drivers using the platform are independent service providers authorized by local government transport regulations.
3. User Registration and Accounts
Users must provide complete, accurate, and current information during registration.
Drivers and operators must upload valid government-issued IDs, permits, insurance, and vehicle registration documents before account activation.
Each account is personal and non-transferable. You are responsible for maintaining confidentiality of your login credentials.
Trisakay reserves the right to suspend accounts found to contain false, incomplete, or misleading information.
4. Use of Services
Use the Trisakay platform only for lawful purposes and in compliance with transport regulations.
Do not engage in activities that disrupt, overload, or impair the platform's performance.
Commuters must request rides truthfully and avoid fraudulent cancellations or no-shows.
Drivers must not solicit passengers or process rides outside of the platform to bypass service fees.
5. Bookings, Fares, and Payments
Fare rates are based on Trisakay's distance algorithm and local government regulations.
Drivers authorize Trisakay to deduct a service fee of up to 20% from completed trips.
Payments and final fare once are completed. Refunds are only issued in verified cases of system or transaction errors.
Trisakay reserves the right to hold or delay payouts if fraudulent activity or pending verification is detected.
6. Cancellation Policy
A cancellation fee of 30% of the estimated fare will be charged if a commuter cancels a confirmed booking after the driver has accepted the ride.
Cancellations made before a driver accepts the booking are free of charge.
Drivers who cancel accepted bookings may face penalties or account restrictions.
Emergency or system-related cancellations may be subject to review and refund consideration.
7. Driver and Operator Responsibilities
Maintain valid permits including Top Permit, OR/CR, Barangay Clearance, Business Permit, and Insurance.
Ensure that tricycles are clean, roadworthy, and compliant with Ormoc City regulations.
Adhere to traffic laws and maintain professional conduct toward passengers.
Report accidents, system errors, or security incidents to Trisakay immediately.
8. Commuter Responsibilities
Provide accurate pick-up and drop-off information when booking rides.
Refrain from verbal abuse, harassment, or damage to vehicles.
Respect drivers' time by minimizing no-shows or last-minute cancellations.
Follow city ordinances and public transport guidelines while using the service.
9. Limitation of Liability
Trisakay acts solely as a facilitation platform and is not responsible for:
Road accidents, injuries, or damages that occur during rides.
Loss of property, delays, or missed bookings due to connectivity issues.
Driver misconduct, unauthorized actions, or third-party disputes.
10. Account Suspension and Termination
Trisakay may suspend or terminate access if users:
Violate these Terms or any applicable law.
Provide falsified or tampered documentation.
Use the platform for illegal or fraudulent activities.
Pending payments or unresolved obligations must be settled before account termination.
11. Third-Party Integrations
Trisakay may integrate with third-party tools such as mapping, payment, or analytics services (e.g., OpenStreetMap, payment gateways). While these enhance our platform, we are not responsible for their performance or privacy practices.
12. Dispute Resolution
Disputes between commuters and drivers should be reported to Trisakay Support for mediation. If unresolved, matters may be referred to the Ormoc City Transport Office or relevant local authority.
13. Modifications to Terms
Trisakay reserves the right to update or amend these Terms to reflect changes in policies, technology, or regulations. Continued use of the platform after modifications constitutes acceptance of the revised Terms.

These Terms are governed by and construed under the laws of the Republic of the Philippines.
